This License Agreement (the "Agreement") is meant for the end user and a legally binding agreement between you (either an organization or company or an individual or an entity or the "User"), and DataHelp® in terms of DataHelp® software (the "Program" or the "Software"), and all successor upgrades, patches, revisions, fixes, copies, maintenance, additions releases of the Software, if any, licensed to you by DataHelp® (collectively, the "Updates"), user documentation and manual explains the product or files in written form, "online" or electronic form (the "Documentation" with the Software and Updates, the "Distribution Package" or the “Product”).
Before downloading, installing or executing this software you are requested to read all of the terms and conditions carefully. In case you do not accept any of these terms and conditions then apparently do not copy, install, download, distribute or install the copy of the software. Your use of the product will be considered as an infringement of the terms of the agreement.
If you have unused package of the software without the activation key, then return of the same is possible within the 30 days of purchase and full refund will be processed. The details regarding the permitted use of the software solutions, are provided under the Terms and conditions of the license agreement meant for each copy of the software.
All rights, expressed or non-expressed, addressed in this license are subjected to DataHelp® software. A Multiuser license purchase from DataHelp® is required, otherwise user will not be allowed to provide the software to several users through network or using any other method.
The software including any documentation, which comes in a distribution package, are meant to be protected by national copyright laws and international agreements. If caught using the product in an unauthorized way, then it will lead to immediate and automatic termination of this license and could be prosecuted under the charge of breaking the civil law. Possession or installation as well as use of our product is not meant for transferring rights on that intellectual property except it is explicitly mentioned in the agreement.
If the user participates in any online survey or contest conducted by Datahelp Software, the personal information provided by the user is saved into the database. This will be used to notify the winners and award prizes.
DataHelp® has sole right over its products, which comes under the copyright law. So, nobody is permitted to remove or conceal labels, proprietary notices from the corresponding software.
Non-Exclusive license, granted for using the Product, stated as:
Single User License (Personal License) – In case user is owning single user license, the product could be used, as stated in the agreement, for non-commercial purposes. This license is meant for non-exclusive and non-transferable right for installing or activating the product but on single computer.
Multi User License (Business / Educational Institutes/ Defence Establishments / Corporate Clients/ Government Organizations) – for the owner of Business License, it is permitted to use product for unlimited systems located within the office, at one location. Enterprise License is required if use of the product is needed for government, corporate or any other global business environment. This will make owner eligible to use the PRODUCT for Unlimited number of computers situated in all the branches of that enterprise.
Registration code - It is a Unique Identification File which confirms the purchase of the license from DataHelp®. It may include the details of the license and facilitate the full functionality of the product, in line with the Agreement.
And this registration code which is provided by the DataHelp® comprises of ownership information of DataHelp®. To confirm user accepts that no copy, transfer, disclose or providing confidential information available to any third party, in any form will be made, until it is provided in written form by DataHelp®. It is expected that user accepts implementing security measures in order to protect confidential information provided by DataHelp®.
ACKNOWLEDGMENT - If Installing Software, you acknowledge the fact that you have read as well as understood the aforesaid and accepts the terms and condition. It is accepted by you that this agreement is complete and exclusive avowals between the parties and substitute all previous or proposed agreements whether oral or in written including any other communications help in between related parties for the license stated over here.
DATAHELP® HAS NO LIABILITY TOWARDS ANY DAMAGE (WITHOUT LIMITATION, LOSS OF ANY SORT OF BUSINESS DATA, BUSINESS PROFIT DAMAGE, BUSINESS INTERRUPTION OR ANY OTHER MONETARY LOSS), INTERRUPTION, CONSEQUENTIAL, INCIDENTAL OR INDIRECT DAMAGE CAUSED USING THIS PRODUCT OR INABILITY TO EXECUTE THIS OR LACK OF PROVISIONING OF SUPPORT SERVICES. DATAHELP®‘S LIABILITY IS LIMITED TO THE AMOUNT PAID AT THE TIME OF SOFTWARE PURCHASE.
DataHelp® gives no warranty that the product is error free. DataHelp® disclaims any other warranty respective to the product, whether prompted or implied, comprising but not restricted to implicit warranties of marketability, fitness for a particular purpose and non-infringement of third party rights. EXCLUSION OF IMPLIED WARRANTIES AND RESTRICTIVENESS TOWARDS THE TIME LIMIT Specified FOR WARRANTY OR THE EXCLUSION OF THE INICIDENTAL OR CONSEQUENTIAL DAMAGE LIMTATION ARE NOT ALLOWED BY SOME JURIDICTION. Here above mentioned exclusions as well as limitations may not be applicable to you. SO THIS WARRANTY PROVIDES PARTICULAR LEGAL RIGHTS WHICH MAY BE DIFFERENT FOR ONE JURIDICTION TO ANOTHER.
This is a legal licensed software which is meant to be used for a legal owner of all files or data required to be recovered, converted or exported using this software Or having permission of the actual owner to perform such operations. You are solely responsible in case of any kind of illegitimate usage of our product. And you assert that legal rights, to access the data or hidden files, vested in you. Further it should be confirmed that the restored data, password and /or files will not be illegally used. PASSWORD RECOVERY OR OTHER KIND OF DATA DECRYPTION OF ILLEGALLY OBTAINED FILE MAY FOUND THEFT OR wrongful action WHICH MAY LEAD TO CIVIL OR CRIMINAL PROSECUTION AGAINST YOU.
This License comes under the governance of State Of Maharashtra, India. Matters related to the License come under the jurisdiction of the courts belongs to state of Maharashtra, India and you shall be abide by their law. No third party beneficiaries of any obligations, promise or representation is being made by DataHelp®. This license establish complete statement of agreement for the parties of the subject matter and all understandings, purchase order, arrangements are vested in it. In case of the invalidity of any facility of the license, the parties accepts validity of the remaining portions of the license shall not be influenced by the invalidity of this sort.
This license agreement will be in effect until terminated. In case all the copies of the software are destroyed consequently, license agreement shall also be terminated. If you fail to act in accordance with any terms or condition, that case as well this License agreement will also be terminated. In case of any sort of TERMINATION, user needs to accept software along with all its copies are meant to be destroyed.
All Rights not explicitly approved here are reserved by DataHelp®.
